Americans with Disabilities Act of 1990

A Disability Discrimination Lawyer Fighting on Your Side

If you have a disability, then you have the right to fully participate in our society. But until 1990, disability discrimination was both common and, for the most part, legal. With the passage of the Americans with Disabilities Act (ADA), things finally changed.

Attorney Lance Wogalter has done groundbreaking work in Florida disability law, much of it dealing with accessibility to public facilities and businesses. His work has been cited in numerous articles and he has also personally written a number of articles on the subject himself. To schedule an initial consultation, contact his offices today.

Attorney Lance Wogalter's work has made conditions throughout Florida better for disabled individuals. He has faced off against former Congressman Mark Foley over disability discrimination issues.

ADA Accessibility Violations

All public buildings need to be accessible to disabled individuals. This means, for example, that there need to be ramps for people with wheelchairs, or level door handles for people who can't turn circular ones. In addition, public information needs to be available in Braille, and public institutions need have TTY or TTD telephones so that deaf individuals can communicate with them.

However, these requirements don't stop with public buildings and institutions. Private businesses also need to be handicap accessible. As a potential customer to their business, you are considered an “invitee” to their store. They have advertised for your business, and so they have a legal obligation to make sure that you aren't excluded on the basis of your disability.

Disability Discrimination in the Workplace

Disability discrimination should never keep you from being able to hold a job and support yourself. Employment law and the ADA both state that your employer is required to make reasonable accommodations to allow you to perform the central functions of your job. In addition, it is considered wrongful termination if you are fired because of your disability.
